Equal Treatment for Part - Time Workers


The Regulations implement the Part-Time Work Directive (97/81 EC) which was extended to the UK when the Government signed up to the EU Social Chapter.

From July 2000, part-time workers are be protected from discrimination on the grounds of their part-time status.  Until then, UNISON had to prove indirect discrimination under the sex discrimination or equal pay legislation to challenge discrimination against part-time workers.  Now, men working part-time will be protected from discrimination, and women working part-time will be able to compare themselves with women working full-time in order to challenge discrimination.
However, because of UNISON's concerns about some of the provisions in the Regulations, outlined in the comments in this briefing, UNISON believes that it may still be advisable, where appropriate, to lodge claims under the Sex Discrimination Act or Equal Pay Act as well as these Regulations.
