Are there any legal requirements that Barnardo's should comply with if there are redundancies identified?
It is a legal requirement to notify the Secretary of State of any proposals detailing 20 or more redundancies occurring at the same establishment (where redundancies are occurring at different establishments notification is not required, unless there are more than 20 at one of the individual establishments). The relevant HRM will ensure the appropriate process is undertaken. The notification times are the same as the time limits for consultation. » more
Can I accept the "suitable" alternative employment on a trial basis?
All offers of alternative employment that result in some form of change in terms and conditions of employment will be subject to a trial period of 4 weeks commencing from the date when the employee begins work under the new contract. The line manager may agree an extension to the trial period of up to 6 months for training purposes. This must be detailed in the offer letter. If an employee resigns during the trial period and Barnardo's accepts that the resignation does not constitute an unreasonable refusal of alternative employment, then redundancy pay calculated under the former contract of employment will be granted. Similarly, if Barnardo's dismisses the staff member or gives notice within the trial period, s/he will get a redundancy payment as above, unless the dismissal is for an unconnected reason e.g. gross misconduct. » more
Does Barnardo's have a selection criteria for redundancy ?
Wherever possible, voluntary redundancy will be considered on all occasions however, Barnardo's reserves the right to refuse an application for voluntary redundancy if it is not considered to be in the best interests of the organisation. Staff will be asked to inform management in writing if they wish to be considered for voluntary redundancy, either during or immediately after the consultation period. Redundancy quotes will be provided to such staff. Any quote given will not constitute a formal offer of redundancy, but will be to enable staff to make an informed decision as to whether they wish to proceed with an application for voluntary redundancy. Following receipt of a quote, staff who do wish to make a formal application for voluntary redundancy must confirm this in writing to the manager within the timescales outlined during the consultation. » more
